The Gift of Ganja, How to Safely Gift Marijuana This Holiday Season

by | Dec 24, 2021 | Criminal Defence

Nothing beats a homemade gift.  Unwrapping something that someone else made makes a gift extra special.  The crew here at CCD Law hopes that you had a great harvest this year and if you are looking to give the gift of ganja this holiday season, please ensure that you do it legally.
As crazy as it sounds, there are different rules around possessing marijuana than other regulated substances like tobacco or alcohol.  It is important to note that pot is still a very controlled uncontrolled substance.  When delivering your gifts this year, it is important to remember that the pot in your car cannot be accessible to anyone in the vehicle.  You can’t keep it in a gift bag on the backseat.  The glove box or center console is a no no as well.  If a police officer has reason to believe that there is marijuana in the vehicle that is accessible to any person in the vehicle they have the authority to search the whole vehicle and anyone in it.
Although you can give your mom a lovely flowering Poinsettia, you can not give her a flower cannabis plant.  The law prevents people from transferring a flowering marijuana plant to another.  Give the gift of seedlings. What is that they say, give a person a fish and they eat for a day but teach them how to fish and…On that note remember as well that you could give your mom 5 Poinsettia plants but the maximum number of pot plants per household (not per household member) is 4.
Although your buds were bountiful this summer, keep your gift to to 30 grams or under.  It is illegal to possess more than 30 grams in public.  I can pack a keg in the car and head off to family Christmas but the same can’t be said for marijuana.  If you are traveling to a holiday celebration, then it is likely that you will be “in public” at some point thus, your generosity is government regulated at 30 grams.
It is not a gift if someone pays you for it.  Marijuana is legal but that doesn’t mean you can sell what you grew.  If the police put a damper on your holiday gift giving please do not hesitate to call the team at Cake Criminal Defence. We defend!
